Consumer Health Data Policy

This Consumer Health Data Privacy Notice (“Notice”) supplements Trainest’s Privacy Policy and applies to residents of U.S. states with laws governing the collection, use, and sharing of Consumer Health Data (“CHD”) — such as Washington’s My Health My Data Act and Nevada’s SB 370. This Notice applies to Trainest, Inc. and any affiliated services provided through our mobile app, website, and integrations (“Trainest”, “we”, “our”).
In the event of a conflict between this Notice and any other policy, this Notice controls with respect to Consumer Health Data.
1. What Is Consumer Health Data?
For purposes of this Notice, Consumer Health Data is information that is linked (or reasonably linkable) to you and that identifies or is used to infer your physical or mental health status. This may include:

Fitness goals and progress (e.g., performance history, goals, workout records)

Body metrics (e.g., height, weight, heart rate, calories, steps)

Injury history or disclosed medical considerations

Exercise behavior, sleep data, and check-ins

Health-related data imported from third-party apps (e.g., Apple Health, Google Health Connect)

Other information you voluntarily share about your health in assessments or chat
2. Sources of Consumer Health Data
We may collect CHD:

Directly from you when you complete assessments, update your profile, track workouts, or provide feedback

Automatically, through third-party integrations like Apple Health or Google Health Connect (only if you give permission)

From your device, such as step count, heart rate, or calories (with consent)

Via support or feedback interactions, if you voluntarily share health-related data
3. Why We Collect and Use Consumer Health Data
We process your CHD to provide the services you’ve requested or authorized, including:

Delivering personalized training plans and exercise recommendations

Tracking your performance and progress over time

Syncing with third-party health tools for a more accurate coaching experience

Troubleshooting, analytics, and performance improvements

Ensuring app functionality and maintaining secure, reliable operations

Complying with applicable legal obligations
4. How We Share Consumer Health Data
Trainest does not sell Consumer Health Data.
We may share CHD with the following parties only as necessary to provide services or comply with the law:

Certified in-house coaches to personalize your training

Third-party platforms you choose to integrate with (e.g., Apple Health, Google Health Connect)

Service providers supporting hosting, analytics, or cloud storage

App store providers for subscription billing (e.g., Apple, Google)

Law enforcement or regulatory bodies, if legally required
All vendors and partners are bound by agreements to use CHD solely for authorized purposes and not for advertising or resale.
5. Your Rights Over Consumer Health Data
If you are a resident of a state with CHD laws (e.g., WA, NV), you may have the right to:

Confirm whether Trainest is collecting or sharing your CHD

Request access to your CHD or copies of it

Request corrections to inaccurate or incomplete CHD

Request deletion of CHD

Withdraw consent for processing or sharing CHD
To exercise any of these rights, email support@trainest.com. You may be asked to verify your identity. We will respond within the timeline required by law (typically 45 days).
6. Appealing a Denied Request
If we deny your request to access, correct, or delete your CHD, you may submit an appeal by contacting us at support@trainest.com with the subject line: Appeal – Consumer Health Data Request.
If you’re a Washington resident and your appeal is denied, you can also contact the Washington State Attorney General at: https://www.atg.wa.gov/file-complaint
7. Data Security & Retention
We implement reasonable security measures to safeguard CHD against unauthorized access, use, or disclosure. CHD is retained only as long as necessary to fulfill the purpose for which it was collected or to meet legal obligations.
8. Updates to This Notice
We may update this Notice as state laws evolve. The most recent version will always be posted at https://trainest.com/privacy-policy. The effective date reflects when changes were last made.
