Trainest, Inc. (“we,” “our,” “us,” or “Trainest”) is committed to protecting your privacy. This policy explains how your personal information is collected, used, and disclosed by Trainest.

This policy describes the type of information we may collect from you or that you may provide when you visit the website https://trainest.com or its associated subdomains (our “Website”), or our mobile application, Trainest (collectively, our “Services”), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy does not apply to workforce-related personal information, job applicants, contractors, or similar individuals.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is to not use our Services. By accessing or using our Services, you agree to this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of these Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

1. Children Under the Age of 13

Our Services are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on our Services. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on these Services or through any of their features, register on the Services, make any purchases through the Services, use any of the interactive or public comment features of these Services, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at support@trainest.com.

2. What Information Do We Collect?

We collect several types of information from and about you when you visit our Services, register on our Services, place an order, subscribe to our newsletter, respond to a survey, or fill out a form, including information:

  • By which you may be personally identified, such as name, username and password, postal address, email address, telephone number, pictures you choose to upload in the photo gallery, or any other identifier by which you may be contacted online or offline (collectively, “personal information”);
  • That is about you but individually does not identify you, such as age, weight, height; and
  • About your internet connection, the equipment you use to access our Services, and usage details.

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the Services. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
  • From third parties, for example, our business partners.

2.1. Information You Provide to Us

The information we collect on or through our Services may include:

    • Information that you provide by filling in forms on our Services. This includes information provided at the time of registering to use our Services, subscribing to our Services, or posting material. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our Services.
    • Information that you provide about your training sessions, your training preferences (e.g. types of workouts, frequency of workouts, coaching plans), your diet and nutrition habits, your overall performance and progress on training programs, and all other information useful for improving your performance and delivering the Services to you.
    • Health data made available by the native health app or platform of your mobile device (e.g. “Health” on iPhone/iOS, “Health Connect” on Android) (the “Health App”), if you choose to connect our Services to the Health App and share health data. The list of available data depends on your configuration and the rights and permissions granted, but may include items such as height, weight, age, heart rate, body fat percentage, steps, exercise minutes, total calories, and active calories.
      • If you give Trainest permission to access data from your Health Connect application, we will use that information in accordance with this Privacy Policy, to provide you with the Services, and in compliance with the Google API Services User Data Policy, including the Limited Use requirements.
    • Records and copies of your correspondence (including email addresses), if you contact us.
    • Your responses to surveys that we might ask you to complete for research purposes.
    • Details of transactions you carry out through our Services and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Services.
    • Your search queries on the Services.

You also may provide information to be published or displayed (hereinafter, “posted“) on public areas of the Services (e.g. in the Client Community forums), or transmitted to other users of the Services or third parties (collectively, “User Contributions“). Your User Contributions are posted on and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

2.2. Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

    • Details of your visits to our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Services.
    • Information about your device (e.g. computer, phone, or tablet) and internet connection, including your IP address, operating system, and browser type (if applicable).

The information we collect automatically may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to:

    • Estimate our audience size and usage patterns.
    • Store information about your preferences, allowing us to customize our Services according to your individual interests.
    • Speed up your searches.
    • Recognize you when you return to our Services.

The technologies we use for this automatic data collection may include:

    • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Services.
    • Web Beacons. Pages of our Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).

2.3. Information We Collect Through Third Parties

Trainest will collect data necessary to provide the Trainest services to our customers.

We may also receive some information from third parties when you contact us. For example, when you submit your email address to us to show interest in becoming a Trainest customer, we receive information from a third party that provides automated fraud detection services to Trainest.

2.4. Interest-Based Advertising

In our commitment to your privacy and to maintain transparency and control over your personal information, we adhere to the principles of the Digital Advertising Alliance (DAA) in the U.S. and DAAC in Canada.

For those interested in more information about interest-based advertising or wishing to opt-out, we provide the following options:

    • For U.S. residents, and residents of other countries not listed below, you can visit DAA
    • For Canadian residents, you can visit DAAC
    • The DAA offers an application called AppChoices that provides users with the ability to control interest-based advertising on mobile apps. This app is available for download in various app stores. 
    • Users may opt out of certain advertising features through their device settings, such as the device advertising settings for mobile phones or ad settings in general. 
    • Any opt-out feature provided by any of the services listed in this document.

3. Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Services are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Services. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. 4. How Do We Use The Information We Collect?

Any of the information we collect from you may be used in one of the following ways:

  • To present our Services and their content to you.
  • To provide you with information, products, or services that you request from us.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account or subscription(s), including expiration and renewal notices.
  • To “retarget” you (i.e. with the help of third parties, displaying ads on other websites based on your past transactions with us).
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To personalize your experience, ensuring that you receive tailored coaching and training support (your information helps us to better respond to your individual needs).
  • To improve our Services (we continually strive to improve our Services based on the information and feedback we receive from you).
  • To improve customer service (your information helps us to more effectively respond to your customer service requests and support needs).
  • In any other way we may describe when you provide the information.
  • For any other purpose with your consent.

5. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates (including any person or entity which directly or indirectly controls, is controlled by or is under common control with Trainest, whether by ownership or otherwise).
  • To contractors, service providers, and other third parties we use to support our business.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Trainest’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Trainest about users of our Services is among the assets transferred.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms and Conditions and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Trainest, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

6. How Long Do We Keep Your Information?

We keep your information only so long as we need it to provide Trainest to you and fulfill the purposes described in this policy. This is also the case for anyone that we share your information with and who carries out services on our behalf. When we no longer need to use your information and there is no need for us to keep it to comply with our contractual, legal, or regulatory obligations, we’ll either remove it from our systems or depersonalize it so that we can no longer identify you.

7. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Services may then be inaccessible or not function properly.
  • Promotional Offers from Trainest. If you do not wish to have your contact information used by Trainest to promote our own or third parties’ products or services, you can opt-out by:
    • checking the relevant box located on the form on which we collect your data (the registration form);
    • clicking on the unsubscribe or opt-out link we include at the bottom of all promotional emails we send to you; or
    • by sending us an email stating your request to support@trainest.com.

This opt out does not apply to information provided to Trainest as a result of a product service experience or other transactions.

Some web browsers may transmit “do-not-track” (or “DNT”) signals to websites they connect to. As there is no standard universally accepted for DNT signals, we do not process such signals and we do not change our practices (described in this policy) in response to DNT settings of your browser. Some of our third party partners may collect or receive information about you as stated in this policy and they may or may not process DNT signals, as we do not require from them to process DNT signals.

8. How Do We Protect Your Information?

We have implemented data security measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls and most communications are encrypted using SSL/TLS technology.

Any payment transactions are delegated to our trusted payment service gateway, Stripe, Inc., which applies industry-standard encryption and security measures and complies with PCI-DSS.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot, however, ensure or warrant the absolute security of any information you transmit to Trainest or guarantee that your information on the Services may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, technical, or managerial safeguards. Any transmission of personal information is at your own risk.

9. Could my information be transferred to other countries?

Trainest is incorporated in California. Information collected via our Services, through direct interactions with you, or from use of our help services may be transferred from time to time to our offices or personnel, or to third parties, located throughout the world, and may be viewed and hosted anywhere in the world, including countries that may not have laws regulating the use and transfer of such data. To the fullest extent allowed by applicable law, by using our Services, you voluntarily consent to the trans-border transfer and hosting of such information.

10. Can I access, update, or correct my information?

You can review and change your personal information by logging into your account and visiting your profile page.

You may also send us an email at support@trainest.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users. Proper access and use of information provided on the Services, including User Contributions, is governed by our Terms and Conditions.

You should be aware that it is not technologically possible to remove each and every record of the information you have provided to us from our system. The need to back up our systems to protect information from inadvertent loss means that a copy of your information may exist in a non-erasable form that will be difficult or impossible for us to locate. Promptly after receiving your request, all personal information stored in databases we actively use, and other readily searchable media will be updated, corrected, changed, or deleted, as appropriate, as soon as and to the extent reasonably and technically practicable.

11. Changes To Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page with a notice that the privacy policy has been updated sent to you by email to the email address specified in your account. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting this privacy policy to check for any changes.

12. California Residents

The California Online Privacy Protection Act (“CalOPPA”) requires us to disclose categories of personal information we collect and how we use it, the categories of sources from whom we collect personal information, and the third parties with whom we share it, which we have explained above.

At the time this policy enters into force, we are not subject to the provisions of the California Consumer Privacy Act (the “CCPA”), as Trainest does not exceed the thresholds to fall within the definition of a “business” under the CCPA.

We do not sell the personal information of our users.

13. Nevada Residents

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address: support@trainest.com.

However, please know we do not currently sell data triggering that statute’s opt-out requirements.
